This page outlines the terms and conditions regarding personal data processing activities of GIANTY VIETNAM COMPANY LIMITED (hereinafter referred to as “RECRUITER”). By providing your personal information, you acknowledge and agree to be bound by the following terms and conditions.
1. Definitions
1.1. Personal Data means information in the form of symbols, letters, numbers, images, sounds, or similar forms in an electronic environment that is associated with a specific individual or helps identify a specific individual. Personal data includes Basic personal data and Sensitive personal data.
Information that helps identify a specific individual is information generated from an individual’s activities that, when combined with other stored data and information, can identify that individual, including but not limited to IP addresses, cookies, job search behavior data, access devices, or location data.
Personal data provided by the Data Subject to the Data Controller or collected by the Data Controller before or during the process of the Data Subject applying for positions being recruited by the Data Controller.
1.2. Basic personal data includes: full name, middle name and birth name, other names (if any); date, month, year of birth; date, month, year of death or going missing; gender; place of birth, place of birth registration, permanent residence, temporary residence, current residence, hometown, contact address; nationality; personal image; phone number, identity card/citizen identification card number, personal identification number, passport number, driver’s license number, license plate number, personal tax identification number, social insurance number, health insurance card number; marital status; information about family relationships (parents, children, grandparents, spouse, biological siblings, parents’ biological siblings and others with family relationships); information about the individual’s digital account; personal data reflecting activities and activity history on cyberspace; other personal data associated with or helping to identify a specific individual (not falling under the provisions of Clause 1.3 of this Article).
1.3. Sensitive Personal Data refers to information including: Health status and private life recorded in medical records; political views, religious views; information related to racial or ethnic origin; information about physical attributes and unique biological characteristics of an individual; bank account information; location data of an individual when performing certain tasks; and other Personal Data prescribed by law as Sensitive Personal Data.
1.4. Personal Data Processing refers to one or more activities affecting Personal Data, such as: collection, recording, analysis, confirmation, storage, rectification, disclosure, combination, access, retrieval, sharing, transmission, provision, transfer, erasure, destruction of personal data or other related actions in accordance with the law on personal data protection.
1.5. The relationship between you and the RECRUITER during the processing of your Personal Data is as follows:
- You are the Data Subject.
- The RECRUITER shall be the Data Controller or Personal Data Controller and Processor of your personal data.
- The party authorized by the RECRUITER to process the personal data provided by you shall be the Data Processor.
2. Types of personal data processed
Personal data processed includes the data provided by the Candidate to the RECRUITER when researching and applying for job positions advertised by the RECRUITER, specifically as follows:
- Basic Personal Data as stipulated in Clause 1.2, Article 1 of this Document; and
- Sensitive Personal Data as stipulated in Clause 1.3, Article 1 of this Document.
- Information and data arising during the process of interaction, application submission, interview, competency assessment, or job discussion between the Candidate and the RECRUITER.
The RECRUITER shall only process personal data within the scope necessary to achieve the notified legitimate purposes, and must ensure that the data is collected legally and transparently.
3. Processing of your personal data
The RECRUITER will, by itself or through a service contract or similar agreement, authorize a Personal Data Processor to process the personal data provided by you.
Your personal information and/or personal data may be transferred abroad, stored, or processed outside of your country for the Purposes set forth in Article 5 of this Confirmation.
THE EMPLOYER shall only transfer your personal data abroad in accordance with the provisions of the law on personal data protection.
In the event of cross-border data transfer, THE EMPLOYER undertakes to: (i) fully comply with the provisions of Decree 356/2025/ND-CP; (ii) notify the competent state management agency of the data transfer activity; and (iii) ensure that data is protected according to standards equivalent to the provisions of Vietnamese law on personal data protection.
4. Who your personal data may be shared with
THE EMPLOYER may share your Personal Data with third parties including:
- member companies, parent companies, affiliates, individuals/organizations acting as consultants to carry out THE EMPLOYER’s recruitment purposes;
- data processors authorized by THE EMPLOYER to perform personal data processing activities under a contract or legal agreement;
The sharing of personal data shall only be carried out after THE EMPLOYER has: (i) notified you of the identity, scope, and purpose of the data recipient; and (ii) obtained your consent for each party or each group of subjects to whom the data is shared.
5. Purposes of processing Personal Data
THE EMPLOYER processes personal data provided by you for the following purposes:
- Organizing interviews;
- Conducting tests and assessments to determine your suitability for the recruitment position;
- Communicating and contacting you throughout the recruitment process, including requesting additional information if necessary;
- Background checks and verification of information regarding educational background, work experience, and references;
- In the event that you are recruited to work for THE EMPLOYER, we will use your personal information to fulfill obligations under the contract between you and THE EMPLOYER as well as in accordance with the provisions of current law during the period of employment and after your resignation;
- If you sign a contract with us, your profile may be used for assigning you to future projects;
- Storing records to build and manage a potential candidate file for future recruitment purposes of THE EMPLOYER;
- Notification of job vacancies, future news updates.
If you consent to our processing of personal data for the purposes stated above, we may also use this information to protect our legitimate rights and interests in the event of any disputes arising from the recruitment process.
6. Rights of the Data Subject
As a Data Subject, you shall have the following rights:
- To rectify/update inaccurate or incomplete personal data;
- To request the Data Controller to delete personal information being stored by the Data Controller.
In addition, the Data Subject has other rights regarding their personal data as prescribed by law.
7. Retention of Personal Data
The Data Subject’s personal data will be stored from the time the recruitment relationship with the RECRUITER arises until you request the RECRUITER to delete your personal data, except in cases where you become an employee of the RECRUITER, in which case your Personal Data will be stored in accordance with labor laws or other relevant regulations.
8. Reference Check
The RECRUITER may conduct your background check independently or through a third party on our behalf. Reference checks will only involve information regarding your previous employment history or other scopes permitted by law and directly serve recruitment purposes.
You warrant that you have obtained all necessary consent from your referees for providing their information in your application file so that the RECRUITER or an authorized party may contact and verify your information.
9. Withdrawal of Consent
You may notify us of the withdrawal of your consent for the continued use, disclosure, storage, and/or processing of your Personal Data for any of the purposes stated above at any time by contacting the RECRUITER at the following information:

In the event that you withdraw your consent, the RECRUITER will be unable to continue processing your application. Your profile may be deleted from the system, and the recruitment process for you will be terminated. This may result in your inability to continue participating in interviews, assessments, or receiving recruitment results from the RECRUITER.
Previously provided data will not be used or processed for any other purposes unless otherwise prescribed by law.
10. Risks and Safety Measures
The Data Subject is aware that even if the Data Controller and/ or the Data Processor apply the strictest security and management measures, the risk of cyberattacks or data theft may still occur.
In cases of incidents or force majeure, the Data Subject understands that they may face risks from their personal data being used unlawfully and they may bear risks related to fraudulent acts or other illegal activities by unauthorized users.
11. Limitation of Liability in the Protection of Personal Data
As soon as the RECRUITER receives the candidate’s Personal Data, the RECRUITER will apply appropriate technical and management measures in accordance with current legal regulations to ensure the safety and security of Personal Data on the RECRUITER’s system.
However, the Data Subject understands and acknowledges that, in the event the Data Subject actively shares, discloses, or transmits their Personal Data via the Internet or online platforms, such Personal Data may be collected, used, or accessed by third parties beyond the reasonable control of the RECRUITER, and the RECRUITER shall not be held responsible for these actions.
The Data Subject also understands that no data transmission system over the Internet can guarantee absolute security. Therefore, although the RECRUITER has made and will make reasonable efforts to protect the Data Subject’s Personal Data in accordance with the law, the RECRUITER does not provide any absolute warranties or commitments that Personal Data will not be subject to unauthorized access, loss, leakage, or compromise due to causes beyond the RECRUITER’s reasonable control.
In the event of risks, damages, or incidents related to Personal Data that do not arise from the intentional fault or breach of legal obligations by the RECRUITER, the Data Subject agrees that the RECRUITER shall not be legally liable, and the Data Subject waives the right to complain, sue, or claim compensation against the RECRUITER regarding such risks or damages.
12. Confirmation of Consent to Provide and Allow the Processing of Personal Data
By ticking the box “Agree” or performing the confirmation action on the website of THE RECRUITER, you confirm that you have read and understood the content of the Notification herein and agree to allow THE RECRUITER to process your personal data in accordance with the scope, purpose, duration, and regulations set forth above.
This confirmation is effective from the time you confirm your consent and may be updated or amended to comply with new legal regulations.
